Purpose

Both freshwater and marine aquaculture development in Scotland is subject to planning permission. From 1 April 2007, local authority planning control was extended to include marine fish farming in coastal waters off Scotland, following several years of concerns that the impact of the huge growth of marine salmon farming in this zone and inadequacies of existing controls. This Knowledge Builder sets out the law and policy in relation to aquaculture in Scotland.

Benefits

All new aquaculture proposals or modifications to existing fish farms require planning permission. Planning authorities will now have to consider planning applications for this form of development. Appropriate policies will require to be included in development plans. Scottish Ministers will consider some proposals as part of the appeal or call-in process.
